          Four hundred and sixty-one dollars and thirteen cents.  That was the amount awarded to our grandfather John Delehanty, and to each of his three surviving siblings following their mother's death in 1901.  John was 15 years old, his elder brother Daniel 21.  His baby brother Mathias was already dead, and while he probably didn't know it, his sister Elizabeth was not long for this world.  Soon she too would succumb to the same horrible disease -- tuberculosis -- that took his father in 1899 and two of his siblings soon after . . .

          In these austere and formulaic court records, one can catch fleeting glimpses of the lives of the deceased before their passing, and of the lives of the family members they left behind.  Records for the estate of Mathias Delehanty, for instance, show his widow Bridget Waters Delehanty accumulating a string of small debts, doubtless in anticipation of the probate settlement.  A couple of hundred dollars for groceries at the Hazard's store in West Castleton, less than a mile from the boarding house where she raised her six children.  Eight dollars and eighteen cents at Brady Brothers Butcher Shop.  Small draws, on the magnitude of $10 or $20 at a time, for household expenses.  The portrait that emerges from Mathias Delehanty's probate proceedings is of a widow whose resources were stretched thin, and who carefully husbanded the little she had to make ends meet.

     Mathias's brother James, in contrast, left thousands of dollars to his eleven children after sending them to the best colleges and universities in the country (one son becoming a prominent Manhattan attorney; another a medical doctor; and three daughters co-founding Trinity College in Burlington VT).  A similar degree of business success marked the careers of James's brother John, and his business partner Patrick H. Downs.  These probate records confirm what appears in the land records of Fair Haven & Castleton:  that James & John Delehanty, and Patrick H. Downs, each succeeded magnificently in business, and that Mathias Delehanty, our great-grandfather and father of our grandpa John Delehanty, failed miserably.

     In any case, here are the probate records for the estates indexed above, from the Fair Haven Town Offices:

Be it remembered that at a Probate Court held at Castleton in and for said District on the 23rd day of January, A.D. 1900.

Present.  Hon. Henry L. Clark, Judge.  John Delehanty, administrator of Mathias Delehanty late of Castleton in said District deceased presented his administration account for examination settlement and allowance and Bridget Delehanty widow of said deceased made application for an assignment to her of the personal estate of said deceased and it is ordered that said account & said application be & the same accordingly are referred for hearing and decision to a session of said Court to be held at the Probate Office in Castleton in said District on the 5th day of February A.D. 1900, & it is further ordered that notice thereof be given to Mary A. McCormick a daughter & heir of said deceased to the guardian of the minor children of said deceased & to Mary Delehanty guardian of Clyde & Alice Delehanty, minor children of P. J. Delehanty a deceased son of said Mathias by service upon such of them forthwith of a citation  [requiring] them to appear before said Court at said time & place & show cause if any they have why said account should not be approved and allowed and said assignment be made.  Citation issued accordingly.

5 Feb 1900   Assignment to Widow

Mathias Delehanty & Est.   Assignment to Widow

Be it remembered that at a Probate Court held at Castleton within and for said District on the 5th day of February, A.D. 1900.

Present, Hon. Henry L. Clark, Judge.  On application of Bridget Delehanty widow of Mathias Delehanty, late of Castleton, in said District, deceased, intestate, and on notice to all concerned, it is ordered and decreed by said Court that there be and there hereby are set apart out of the personal estate of said deceased and assigned to said widow, the articles named in the schedule hereunto annexed at the prices thereto affixed according to the appraisal, amounting in the whole to the sum of 1806. 37/100 dollars, to be held by her the said widow, her heirs, executors, administrators & assigns to their own proper use, benefit and [beles] of forever, to wit: -- two cows $40, 1 buggy $20.  Household furniture $100.  Money or its equivalent $1646.37.

Be it remembered that at a Probate Court held at Castleton, in and for said District on the 5th day of February, A.D. 1900.

Heretofore, to wit, on the 23rd day of January A.D. 1900 John Delehanty administrator of Mathias Delehanty late of Castleton in said District deceased presented his administration account and the same was thereupon referred for hearing, settlement & decision to a session of said Court to be held this day at the Probate Office in Castleton, in said District and it was further ordered that notice thereof be given to all concerned, to wit, to Mary A. McCormick, to the guardian of Clyde & Alice Delehanty, minor children of Patrick J. Delehanty a deceased son of said Mathias & to the guardian of Daniel L., Margaret A., Elizabeth, John, Ellen Teresa & Mathias Delehanty, minor children of said deceased [to] service upon of them forthwith of a citation requiring them to appear this day before said Court & show cause why said account should not be approved and allowed.  Said order of notice was duly complied with said citation duly issued to & service thereof accepted and acknowledged by said parties & said administrator having been duly sworn to the truth and correctness of said account and no cause being shown to the contrary, it is ordered that the same be approved, allowed & recorded as follows:

Bridget Delehanty Estate

BE IT REMEMBERED, That at a Probate Court, held at Castleton, in and for said District, on the 11th day of October, A.D. 1901

Present, Hon. Henry L. Clark, Judge

WHEREAS, Bridget Delehanty, late of Castleton in said District, deceased, has lately died intestate, leaving goods, chattels, rights, credits and estate

THEREFORE, it is ordered by said Court, that John Delehanty of Fairhaven in said District be and he accordingly is appointed administrator of the estate of said deceased, and he accepts said trust and gives bond in the sum of three thousand dollars, conditioned as required by law . . . Mary McCormick of Granville in the State of New York, surety.

ORDERED, that said administrator make and return to said Court, within three months under oath, according to her best knowledge, information and belief, a true and perfect inventory of the goods, chattel, rights, credits and estate of said deceased, which have or shall come to her possession or knowledge, or to the possession of any other person for her, administer the same according to law, and render a just and true account of her administration to said Court within one year.

Bridget Delehanty Estate

BE IT REMEMBERED, that at a session of the Probate Court for the District of Fairhaven, held at Castleton, in and for said District on the 4th day of March, A.D. 1902.

Present, Hon. Henry L. Clark, Judge

John Delehanty, Administration of the estate of Bridget Delehanty late of Castleton in said District, deceased, presents his administration account for examination and allowance, and makes application for a decree of distribution and partition of the estate of said deceased.  Whereupon it is ordered by said Court, that said account and said application be referred to a session thereof, to be held at the Probate Office in said Castleton, on the 31st day of March, A.D. 1902, for hearing and decision thereon:  And, it is further ordered, that notice hereof be given to all person interested, by publication of the same three weeks successively in the Fairhaven Era, a newspaper published at Fairhaven in said District, previous to said time appointed for hearing, that they may appear at said time and place, and show cause, if any they may have, why said account should not be allowed, and such decree made.

Be it remembered that at a Probate Court held at Castleton, in and for said District on the 31st day of March, A.D. 1902.

Therefore, to wit, on the 4th day of March A.D. 1902 John Delehanty administrator of the estate of Bridget Delehanty, late of Castleton in said District, deceased, presented to said Court an account of his administration of the estate of said deceased, and the same was by said Court referred for hearing settlement and decision to a session of said Court to be held on this day at the Probate Office in Castleton, in said District and it was further ordered that notice thereof be given to all concerned by publication of said order for three weeks successively previous hereto in the Fairhaven Era a newspaper printed at Fairhaven in said District.

Bridget Delehanty; Est Decree

Be it remembered that at a Probate Court held at Castleton in and for said District on the 31st day of March A.D. 1902

Present, Hon. Henry L. Clark, Judge

Whereas, due notice has been given to all persons interested under the order of said Court by publication for 3 weeks successively previous hereto in the Fairhaven Era, a newspaper printed at Fairhaven in said District; and whereas, it appears from the records and files of said Court & from the account of John Delehanty administrator of the estate of Bridget Delehanty late of Castleton, in said District deceased, intestate that after the payment of the debts and funeral charges of said deceased and the expenses of administration as allowed by said Court, there remains in the hands of said administrator as aforesaid the sum of two thousand two hundred forty four & 52/100 dollars, being a surplus or residue of said estate.

And whereas, it hath been made to appear to said Court that Daniel L. Delehanty, Margaret Delehanty, John Delehanty, and Ellen Teresa Delehanty, children of said Bridget Delehanty, deceased, are all the legal heirs of the said Bridget Delehanty deceased who by law are entitled to the said residue of the estate aforesaid.

It is therefore ordered that the said residue of said estate, be and the same accordingly is assigned & decreed to the aforesaid heirs in the following proportions.

To the said Daniel L. Delehanty one equal fourth part thereof being the sum of $461.13

To the said Margaret Delehanty one equal fourth part thereof being the sum of $461.13

To the said John Delehanty one equal fourth part thereof being the sum of $461.13

To the said Ellen Teresa Delehanty one equal fourth part thereof being the sum of $461.13

To have and to hold the same to them the said Daniel L., Margaret, John & Ellen Teresa their executors administrators & assigns forever.

BE IT REMEMBERED, That at a session of the Probate Court of the said District of Fairhaven, held at Castleton, in and for said District, on the 31st day of March, A. D. 1902.

Present, Hon. Henry L. Clark, Judge.

WHEREAS, John Delehanty of Castleton in said District, a minor, above the age of 14 years, child and one of the heirs at law of Bridget Delehanty late of said Castleton, deceased, has made choice of James Delehanty of said Castleton to be his guardian.

THEREFORE, IT IS ORDERED by said Court, that said James Delehanty of Castleton in said District be, and he accordingly is appointed guardian of said John Delehanty, and he accepts said trust and gives a bond in the sum of one thousand dollars, conditioned as required by law N. J. Delehanty of Rutland in County of Rutland . . .

Patrick H. Downs Estate

BE IT REMEMBERED, That at a session of the Probate Court for the District of Fairhaven, held at Castleton, in and for said District, on the 17th day of November A.D. 1902.

An instrument in writing, under seal, purporting to be the last will and testament of Patrick H. Downs, late of Castleton, in said District, deceased, being presented for probate and allowance by Bridget Downs, the executrix therein named, it is ordered by said Court, that all persons concerned therein be notified to appear before said Court, at a session thereof, to be held at the Probate Office in Castleton, in said District, on the 8th day of December A.D. 1902, and show cause, if any they have, against the probate of said will; for which purpose it is further ordered that this order be published three weeks successively in the Fairhaven Era, a newspaper printed at Fairhaven, in this State, previous to said time of hearing.

Patrick H. Downs Est. Will

Be it remembered that at a session of the Probate Court held at Castleton within & for the District of Fairhaven on the 8th day of December, A.D. 1902.

Present, Hon. Henry L. Clark, Judge.

Heretofore, to wit, on the 17th day of November A.D. 1902 a certain written instrument under seal, purporting to be the last will and testament of Patrick H. Downs, late of Castleton in said District, deceased, having been presented to said Court for probate and allowance by Bridget Downs the executrix therein named; and all persons concerned having been duly notified, under the order of said Court, by publication three weeks successively in the Fairhaven Era, a newspaper printed at Fairhaven, in this state to appear this day and contest the Probate of said will, the same was proved by the oath of James Cummings, one only of the subscribing witnesses (no one appearing to contest the same), who having been duly sworn declared that he saw the said Patrick H. Downs execute the annexed written instrument and heard him declare the same to be his last will and testament; that the said Patrick H. Downs was of full age and sound mind, and that he the said James Cummings and C. E. Cook and E. D. Raymond, the subscribing witnesses severally subscribed the same as witnesses thereof in the presence of said testator, and of each other.

Therefore it is ordered by said Court that the same be approved and allowed as the last will and testament of the said Patrick H. Downs, deceased, and that the same be recorded, and the execution thereof be committed to Bridget Downs, the executrix therein named who accepted said trust and [of an] a bond with sufficient surety according to the statute in such case made & provided said will is in the words and figures following:

 

          I, Patrick H. Downs, of Hydeville in the town of Castleton in the County of Rutland and State of Vermont, being of sound and disposing mind and memory, do make and publish this my last will and testament, hereby revoking all former wills.

1st.     I direct that my executrix hereinafter named so soon as may be after my decease, pay from the proceeds of my estate all my just debts and funeral expenses.

2d.     I direct my said executrix to pay from the proceeds of my estate one hundred (100) dollars for masses to be said for the repose of my soul.

3d.     I direct my said executrix to pay from the proceeds of my estate one hundred (100) dollars for masses to be said for the repose of the souls of my father and mother and for the repose of the souls of my deceased brothers and sisters.

4th.     To the Roman Catholic Orphan Asylum, in the City of Burlington, Vermont, maintained by the Sisters of Providence, I give, and bequeath one hundred and fifty (150) dollars.

5th.     To my dear sister, Annie Bolger, of said Hydeville, I give and bequeath five hundred (500) dollars.

6th.     To my beloved wife, Bridget Downs, I give, devise, and bequeath all the rest, residue and remainder of my property, both real and personal, of whatever name and nature and wherever situate, to her and her heirs forever, the same to be in lieu of all dower rights at law.

7th.     I name and appoint as executrix of this my last will and testament, my aforesaid wife, Bridget Downs, and I direct that she be required to give no bonds for the faithful performance of the trust herein created.

          In witness whereof I have hereto set my hand and seal to this my last will and testament at the aforesaid Hydeville, on the fourteenth day of October in the year nineteen hundred and two.

8 Dec 1902.  Appointment of Executor, Appraisers, and Commissioners

State of Vermont, District of Fairhaven  }  ss

Patrick H. Downs Estate

BE IT REMEMBERED, That at a session of the Probate Court for the District of Fairhaven, held at Castleton, in and for said District, on the 8th day of December A. D. 1902.

Present, Hon. Henry L. Clark, Judge.

WHEREAS, Patrick H. Downs late of Castleton in said District, deceased, has lately died, leaving goods, chattels, rights, credits and estate, and an instrument in writing, under seal, has been this day proved and allowed by said Court, as the last will and testament of said deceased, and whereas Bridget Downs of Castleton in said District is named therein as the executrix thereof.

THEREFORE, IT IS ORDERED by said Court, that the execution of said will and the administration of the estate of said deceased be, and the same accordingly are, committed unto said Bridget Downs, who accepts said trust and gives a bond in the sum of one thousand dollars, conditioned as required by law, James Delehanty of Castleton in said District surety.

ORDERED, that said executrix make and return to said Court, within three months, under oath, according to her best knowledge, information and belief, a true and perfect inventory of all the goods chattels, rights credits and estate of said deceased, which have or shall come to her possession or knowledge, or to the possession of any other person for her, administer the same according to law, and the last will of said deceased, and render a just and true account of her administration to said Court within one year.

Letter testamentary issued accordingly.

APPRAISERS.

IT IS ORDERED by said Court that James Cummings of Castleton and C. E. Cook of Castleton both in said District, be, and they accordingly are, appointed a committee to appraise all the estate, real and personal whereof Patrick H. Downs late of Castleton in said District, deceased, died seized and possessed, and warrant therefor issued returnable in three months.

COMMISSIONERS.

IT IS ORDERED by said Court that James Cummings of Castleton and C. E. Cook of Castleton both in said District, be, and they accordingly are, appointed commissioners to receive, examine and adjust all claims and demands of all persons against the estate of Patrick H. Downs, late of Castleton, in said District, deceased, and all claims and demands exhibited in offset thereto.

ORDERED, that said commissioners, within sixty days, give notice of their appointment, and of the times and places when and where they will meet for the business thereof, and of the time limited for creditors to present their claims, by advertising the same three weeks successively previous thereto, in the Fairhaven Era, a newspaper printed at Fairhaven in the County of Rutland, and by posting up notifications thereof in four public places in said Castleton.

ORDERED, that creditors of said deceased by allowed six months in which to present their claims to said commissioners for examination and allowance.

Patrick H. Downs Est. Account

Be it remembered that at a Probate Court held at Castleton, in and for said District on the 11th day of June, A.D. 1903.

Downs, late of Castleton, in said District, deceased, having given due notice to all concerned that she would this day at the Probate Office in said Castleton render & settle her administration account presented the following account & having been duly sworn to the truth & correctness of the same & no one having appeared or objected thereto & the same appearing to said Court to be just, true & correct, it is ordered that the same be approved, allowed & recorded as follows:

Patrick H. Downs Estate   Decree

Be it remembered, that at a Probate Court, held at Castleton, in and for said District, on the 11th day of June, A.D. 1903.

Present, Hon. Henry L. Clark, Judge.

WHEREAS, due notice has been given to all concerned that said Court would this day at the Probate Office, in Castleton, in said District, hear consider and decide on the application of Bridget Downs, executrix of the last will and testament of Patrick H. Downs, late of Castleton in same District, deceased, for a decree of distribution of the residue of the estate of said deceased, to the person entitled thereto under the said last will and testament of said deceased, and

WHEREAS, it appears to said Court from the records and files thereof and from the account of the said executrix as allowed by said Court that after the payment of the debts of said deceased and the funeral charges and expenses of administration as allowed by said Court, and after the payment of the several specific money legacies given in and by said will there remains in the hands of said executrix the sum of twenty thousand two hundred thirty three dollars and twenty five cents ($20,233.25) residue of personal estate, and also all the real estate whereof the said Patrick H. Downs died seized and possessed, wherever situated and however bounded and described, and

WHEREAS, it appears to said Court that the said Bridget Downs in the only person who according to the terms and provisions of said will under the laws of this State is entitled to said residue of personal estate and to said real estate.

It is therefore ORDERED by said Probate Court that the same be and it accordingly is ASSIGNED and DECREED to her the said Bridget Downs, to have and to hold the same to her and her heirs, executors, administrators and assigns, forever.
